A vegan woman has become increasingly aggravated by her meat loving neighbours and has decided to take them to court because they keep barbecuing meat and fish and the smell keeps flowing over into her garden.
Cilla Carden, from Australia, has felt that there is no option but to take legal action against her neighbours because of the constant smell of meat cooking.
She believes her neighbours knowingly allow smells from their barbecue to breeze into her garden. She blames the smell on not being able to use her garden.
“They’ve put it there so I smell fish, all I can smell is fish… I can’t go out there.”
Carden who works as a massage therapist and neighbour Toan Vu, plus his wife and their children, began their legal battle in late 2018.
Apparently, her claims have been rejected in court for a lack of evidence and then for a second time.
I suppose it’s a difficult thing to prove..
Lawyer John Hammond said that heading to the Supreme Court was definitely an option for Carden, even though it’s an ‘extreme option’.
Carden believes her neighbours are being ‘absolutely deliberate’ in allowing the smells to enter her garden. She’s had enough.
It doesn’t stop there.. she has also complained about the smell of cigarettes and the sound of kids playing with basketballs. She can’t catch a break cans she?
“It’s been devastating, it’s been turmoil, it’s been unrest, I haven’t been able to sleep.”
Vu has said that he only wants to ‘keep the peace’ and has removed the grill from the back yard. He has also prevented his kids from playing in the garden, too.
Oh, and Carden has also complained about the neighbours to the other side of her home as well.
An anonymous neighbour said:
“Ms Carden’s demands were proven to be not reasonable and indeed were to the detriment of the other owners’ ability to enjoy their lots in a reasonable and acceptable manner.”
Carden has showed no sign of giving up.
“If you don’t do it like that, you’re going to be up for a world of misery.”
